ISAC, together with the Workers Action Centre and Parkdale Community Legal Services, recently responded to a consultation held by the Ministry of Labour, Immigration, Training, and Skills Development (MLITSD) on potential changes to the Employment Standards Act, 2000, regarding job postings requirements.
The consultation included questions on what information should be shared with job seekers and interviewees. This included compensation range info, prohibiting “Canadian experience” requirements, use of Artificial Intelligence (AI), and job posting amendments (including whether or not there is an actual vacancy for the job being posted, and rules around following up with interviewees.)
Our submissions include recommendations that aim to increase equity, fairness, and transparency in hiring practices. In addition to our specific recommendations, we also submitted the importance of centring the following core needs for all workers:
- Prioritize minimum standards enforcement by proactively investigating and auditing employer practices;
- Take a more robust approach to pay equity and fairness by instituting anti-retaliation and reporting mechanisms, similar to the Pay Transparency Act, 2018; and,
- Reduce loopholes and exemptions which would allow employers to meet the requirements of the law without engaging in meaningful equity practices.
